1. No Refund Policy

All lead purchases are final and non-refundable, regardless of outcome, contact success, or client interest level. Homzzdesign makes no guarantees as to the quality, conversion, or success of any lead.

2. Use of Leads

Leads are sold as-is based on the project description available at the time of purchase. Contractor is responsible for all follow-up, closing, proposals, and quality of service.

Targeted Leads may be sold to up to 5 contractors.

Exclusive Leads are sold to only one buyer and held exclusively for 10 calendar days.

Confirmed Appointment leads are exclusive and include a meeting setup. If a client fails to show, the lead converts into an Exclusive Lead, and the buyer receives a $200 credit toward a future purchase.

3. Indemnification & Liability Disclaimer

Contractor agrees to indemnify and hold harmless Homzzdesign and its affiliates from any and all claims, disputes, damages, losses, legal fees, or liabilities resulting from:

The Contractor’s actions, performance, or work quality;

Client dissatisfaction, damages, or complaints;

Any construction-related issue arising from Contractor’s service or communications;

Misuse or mishandling of client data provided by Homzzdesign.

Homzzdesign does not act as a contractor, agent, or intermediary in any construction agreement between the Contractor and client.

4. Limitation of Liability

To the fullest extent permitted by law, Homzzdesign’s total liability for any claim related to a lead shall be strictly limited to the price paid for that individual lead.

5. No Right to Sue – Arbitration Clause

Contractor waives any right to sue Homzzdesign in court. Any disputes shall be resolved solely through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), in Los Angeles County, California. Contractor agrees to pay their own legal costs in any arbitration proceedings.

6. Governing Law

This Agreement shall be governed by the laws of the State of California, regardless of where the Contractor is located.
